Injunction ek court ka direct order hota hai: “yeh kaam mat karo” ya “yeh kaam karo”. Civil disputes me yeh bohot powerful remedy hai, specially jab paisa se problem solve nahi hoti – jaise illegal construction rokna, property sale rokna, trade secrets leakage se bachna.
Do main type hote hain: temporary aur permanent.
Temporary (interim) injunction case ke dauran hota hai. Court dekhte hi lagta hai ki agar abhi kuch nahi kiya, to irreparable loss ho jayega – property bik jayegi, trees kaat diye jayenge, confidential data leak ho jayega. Tab wo short-term protection deti hai till final decision.
Permanent injunction final judgment ka part hota hai. Trial ke baad jab court poori tarah convinced ho jaye ki plaintiff right pe hai, to wo defendant ko permanently restrict kar sakti hai – jaise aage se particular encroachment nahi karega, ya kisi trademark ka use nahi karega.
Judge teen cheeze consider karta hai:
- Prima facie case (surface pe aapka case strong lag raha hai ya nahi),
- Balance of convenience (kis taraf benefits zyada, loss kam),
- Irreparable injury (jo sirf paisa se cover nahi ho sakti).
Agar aap injunction lene aa rahe ho, to jaldi aao. Delay court ki sympathy kam kar deta hai.
