Har criminal matter jail aur long trial ke liye hi bana nahi hota. Kuch offences – specially minor personal disputes, financial quarrels, or family-level fights – law allow karta hai ki parties compromise karein. Is process ko compounding kehte hain.
Compounding ka matlab hai victim voluntarily offence “maaf” kar de aur court us basis pe case close kar de. Kuch offences complainant ke bina court ki permission se compound ho sakte hain, kuch me judge ki approval mandatory hoti hai.
Iska benefit:
- Parties ko final closure milta hai,
- System pe burden kam hota hai,
- Jahan actual harm victim ko hi hai, waha unki choice central ban jati hai.
Lekin serious crimes – like rape, dowry death, major economic frauds – generally non-compoundable hote hain. State yaha kehti hai ki nuksaan sirf individual ka nahi, society ka bhi hai; private settlement se public interest hurt ho sakta hai.
Kabhi-kabhi parties “compromise” ke naam pe pressure ya paisa se forced hoti hain; court ko ensure karna padta hai ki consent genuine ho, coercion nahi.
